Age Requirement: You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

Geographic Restrictions: The Service is intended for use by residents of the United States. Users from other jurisdictions use the Service at their own risk and are responsible for compliance with local laws.

Account Creation: You must provide accurate, current, and complete information when creating your account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

User Content: You retain ownership of all content you upload or create using our Service. By using our Service, you grant us a limited, non-exclusive, royalty-free license to process, store, and display your content solely for the purpose of providing the Service to you.

Accuracy of Information: You are solely responsible for the accuracy, truthfulness, and legality of all information you provide in your resumes and cover letters. We do not verify the accuracy of any user-provided information. You acknowledge that submitting false or misleading information in job applications may have legal consequences and could constitute fraud.

You agree not to use the Service to:

• Create resumes containing false credentials, fake degrees, fabricated work history, or misleading information
• Impersonate another person or misrepresent your identity
• Violate any applicable laws, regulations, or third-party rights
• Engage in any activity that could damage, disable, or impair the Service
• Attempt to gain unauthorized access to the Service or its systems
• Use automated scripts, bots, or other automated means to access the Service
• Resell, redistribute, or commercially exploit the Service without authorization
• Upload malicious code, viruses, or harmful content
• Harvest or collect user data without consent
• Use the Service to generate spam or unsolicited communications

Violation of this Acceptable Use Policy may result in immediate termination of your account without refund and may be reported to appropriate authorities.

Free Tier: Users can create and preview one resume for free. Export and premium features require a paid plan.

Free Trial: We offer a free 7-day trial with full Pro access. A credit card is required to start the trial, but you will not be charged until the trial ends. After 7 days, your subscription automatically converts to Pro Monthly at $15.00/month. You can cancel anytime before the trial ends to avoid being charged.

Paid Subscriptions: Premium features require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis as selected by you.

Auto-Renewal: ALL SUBSCRIPTIONS AUTOMATICALLY RENEW unless cancelled before the next billing cycle. You can cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period.

Refund Policy: We offer a 30-day money-back guarantee on initial purchases. Refunds are processed according to our Refund Policy. No refunds are provided for partial billing periods or after the 30-day period.

Price Changes: We reserve the right to modify subscription prices at any time. Price changes will not affect your current billing period. We will provide at least 14 days' notice for price increases.

Chargebacks: If you initiate a chargeback or payment dispute without first contacting us, we reserve the right to immediately terminate your account and pursue collection of any amounts owed, including reasonable attorneys' fees and collection costs.

AI Assistance: Our Service uses artificial intelligence to generate resume content based on your input and job descriptions. AI-generated content is provided as suggestions only and may contain errors, inaccuracies, or inappropriate content.

User Responsibility: YOU ARE SOLELY RESPONSIBLE for reviewing, editing, and verifying ALL content before using it in job applications. You must ensure that all information in your resume is accurate and truthful. We strongly recommend fact-checking all AI-generated content.

No Employment Guarantees: WE DO NOT GUARANTEE that using our Service will result in job interviews, offers, or employment. Job search success depends on many factors beyond resume quality, including but not limited to your qualifications, the job market, and employer preferences.

Third-Party AI: We use third-party AI services (including OpenAI) for content generation. Your use of AI-generated content is also subject to the terms and policies of these third-party providers.

Our Rights: The Service, including its design, functionality, software, algorithms, trademarks, logos, and AI models, is owned by Elyon Engineering LLC and protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or reverse engineer any part of our Service without express written permission.

Your Rights: You retain ownership of your personal information and the factual content you provide. The formatted resume output combining your content with our templates and AI suggestions is licensed to you for personal, non-commercial use only.

Feedback: Any feedback, suggestions, ideas, or other submissions you provide to us become our property and may be used without compensation, attribution, or any obligation to you.

We respect the intellectual property rights of others. If you believe that content on our Service infringes your copyright, please send a DMCA takedown notice to:

Your notice must include: (1) identification of the copyrighted work, (2) identification of the allegedly infringing material, (3) your contact information, (4) a statement of good faith belief, (5) a statement of accuracy under penalty of perjury, and (6) your physical or electronic signature.

Availability: We strive to maintain high service availability but DO NOT GUARANTEE uninterrupted, error-free, or secure access to the Service. The Service may experience downtime for maintenance, updates, or due to technical issues or circumstances beyond our control.

Modifications: We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

Service Credits: For extended outages (more than 24 consecutive hours) affecting paid subscribers, we may, at our sole discretion, provide service credits. Service credits are non-transferable, have no cash value, and expire if not used within 12 months.

By You: You may terminate your account at any time by using the account deletion feature or contacting support.

By Us: We may suspend or terminate your account immediately, without prior notice or liability, if you violate these Terms, engage in fraudulent activity, abuse our refund policy, or for any other reason at our sole discretion.

Effect of Termination: Upon termination, your right to use the Service ceases immediately. We may delete your account data, including all resumes and cover letters, without any obligation to provide copies. Sections of these Terms that by their nature should survive termination will survive, including but not limited to Sections 12, 13, 14, 16, and 17.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Arbitration Agreement: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service, including the validity, interpretation, breach, or termination thereof, shall be resolved exclusively by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in Sacramento, California, or at another mutually agreed location.

Small Claims Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.

CLASS ACTION WAIVER: YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to support@instaresume.pro within 30 days of first accepting these Terms. Your notice must include your name, address, and email address, and state that you wish to opt out of the arbitration agreement.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Jurisdiction: For any disputes not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Sacramento County, California.
